Provider Operating Standards

Provider Operating Standards

Effective: March 2026

These standards apply to Venue Providers and Vendors ("Providers") listing services on the EventSculpt Platform. They are incorporated by reference into the EventSculpt Terms of Service and are in addition to all other provisions of the Terms.

1. Eligibility and Onboarding

To list services on the Platform, Providers must:

  • Complete EventSculpt's onboarding and approval process;
  • Provide accurate and complete information about their business, services, qualifications, and pricing;
  • Maintain all licenses, permits, and certifications required by applicable law for their services;
  • Agree to the applicable fee structure (commission rates or facilitation fee schedule) and payout terms disclosed during onboarding;
  • Establish and maintain an active Stripe account as required for the Provider's service type.

Providers offering Regulated Service Categories (see Terms of Service Section 4.9) must additionally maintain all licenses required for those services (e.g., a valid liquor license for bar and alcohol services) and comply with all applicable regulatory requirements as a condition of listing on the Platform.

Approval to list on the Platform is at EventSculpt's sole discretion and may be revoked at any time.

1.1 Payment Processing Services and Stripe

Payment processing services for Providers on EventSculpt are provided by Stripe and are subject to the Stripe Connected Account Agreement, which includes the Stripe Terms of Service (collectively, the "Stripe Services Agreement"). By agreeing to these terms or continuing to operate as a Provider on EventSculpt, you agree to be bound by the Stripe Services Agreement, as the same may be modified by Stripe from time to time. As a condition of EventSculpt enabling payment processing services through Stripe, you agree to provide EventSculpt accurate and complete information about you and your business, and you authorize EventSculpt to share it and transaction information related to your use of the payment processing services provided by Stripe.

For information about Stripe's acquirers and their contact details, see Stripe's Acquirer Disclosure.

1.2 Data Sharing Authorization

By onboarding as a Provider, you authorize EventSculpt to share your business information and transaction data with Stripe for the purpose of providing payment processing services. You also acknowledge that Stripe may share data with payment method providers, banking partners, and other third parties as described in the Stripe Privacy Policy for verification, risk management, and regulatory compliance purposes.

2. Listing Accuracy and Standards

Providers agree to:

  • Ensure all listing information (descriptions, photos, pricing, availability, capacity, amenities) is accurate, current, and not misleading;
  • Update listings promptly when information changes;
  • Use only photos they own or have rights to use, accurately representing the venue or service;
  • Clearly disclose all fees, restrictions, house rules, and material terms before booking confirmation;
  • Not misrepresent qualifications, experience, certifications, or affiliations.

EventSculpt may remove or modify listings that do not meet Platform standards or that contain inaccurate or misleading information.

3. Responsiveness and Communication

Providers agree to:

  • Respond to booking inquiries within 24 hours during business days;
  • Maintain accurate availability calendars;
  • Communicate professionally and promptly with Clients through Platform messaging;
  • Provide Clients with necessary information for successful events.

Providers with poor response rates or communication may face reduced visibility, account restrictions, or removal from the Platform.

4. Booking Commitments

Once a Booking is confirmed, Providers commit to:

  • Honor the Booking as described in the listing and confirmation;
  • Provide the venue or services as represented;
  • Not cancel confirmed Bookings except in circumstances covered by the Cancellation Policy;
  • Not request or accept payment outside the Platform for services discovered through EventSculpt.

5. Commission, Facilitation Fees, and Payouts

  • Commission (Standard Services). Providers offering standard (non-regulated) services acknowledge and agree to the commission rates disclosed during onboarding.
  • Facilitation Fee (Regulated Services). Providers offering Regulated Service Categories (see Terms of Service Section 4.9) acknowledge and agree to the facilitation fee schedule disclosed during onboarding.
  • Commission and facilitation fee rates may be updated with 30 days' notice.
  • Payout timing and method vary by service type and the Provider's selected cancellation policy tier. See Terms of Service Section 4.6 and Fee Schedule Section 3 for details.
  • Providers are responsible for providing accurate payout information and maintaining active Stripe accounts.

5.1 Payout Eligibility Schedule

For standard services, the payout eligibility schedule determines when earned payouts are released. Your payout eligibility schedule varies by your trust tier:

  • New Providers. 70% of each earned payout is released on the standard schedule (per your selected cancellation policy tier). The remaining 30% is released 72 hours after event completion, aligned with the dispute review window.
  • Verified Providers. 85% of each earned payout is released on the standard schedule. The remaining 15% is released 72 hours after event completion.
  • Trusted Providers. 100% of each earned payout is released on the standard schedule, with no post-event portion.

Providers advance to faster payout eligibility schedules as they build a track record of successful events. A Booking is considered "completed" once the Event has taken place and the Dispute Review Window has closed without an unresolved dispute. Advancement is based on objective criteria, including the number of Completed Bookings and dispute history within a rolling 12-month lookback period, and is evaluated automatically. See Fee Schedule Section 3.1 for specific advancement thresholds.

Providers who receive a lost dispute within the 12-month lookback period may be moved to a lower trust tier. If you believe a tier demotion was made in error, you may request a review by contacting support@eventsculpt.com.

If a dispute is open on a Booking, any unreleased payout portions for that Booking will not be released until the dispute is resolved, regardless of the Dispute Review Window status. If no dispute is filed during the Dispute Review Window, held payout portions are released automatically. See Terms of Service Section 4.6 for auto-release and freeze details, and Section 4.10 for the Dispute Review Window.

For full details on fee calculation, payout percentages, timing, and payment processing responsibilities, see the Fee Schedule.

6. Insurance and Compliance

Providers are solely responsible for:

  • Maintaining appropriate business liability insurance and any other coverage required by law or industry standards;
  • Complying with all applicable laws, regulations, health and safety codes, and permit requirements;
  • Ensuring their venues meet applicable accessibility, fire safety, and occupancy requirements;
  • Obtaining any necessary licenses or permits for events hosted at their venues;
  • Paying all wages, overtime, benefits, and other compensation owed to their employees, contractors, and subcontractors in compliance with applicable federal, state, and local labor laws, including minimum wage, overtime, meal and rest period, and wage statement requirements;
  • Properly classifying their workers as employees or independent contractors under applicable law;
  • Withholding and remitting all required payroll taxes and providing required tax forms to their workers.

Providers offering Regulated Service Categories bear additional compliance obligations, including but not limited to: maintaining required licenses (e.g., liquor licenses), training staff in responsible service practices, verifying the age of consumers where required by law, and complying with all conditions imposed by licensing authorities.

EventSculpt does not verify Provider insurance or compliance and assumes no responsibility for Provider's legal obligations.

7. Performance Standards and Removal

EventSculpt may suspend, restrict, or remove Provider accounts based on:

  • Repeated cancellations or failure to honor Bookings;
  • Consistently poor reviews or Client complaints;
  • Violation of the Terms of Service or Platform policies;
  • Inaccurate or misleading listing information;
  • Failure to maintain required response rates;
  • Safety concerns or legal violations;
  • Any conduct that harms EventSculpt's reputation or other Users.

Removal decisions are at EventSculpt's sole discretion. Providers may appeal by contacting support@eventsculpt.com.

8. Provider Representations

By listing on the Platform, Providers represent and warrant that:

  • They have the legal right and authority to offer the venues or services listed;
  • All information provided to EventSculpt is accurate and complete;
  • They will comply with all applicable laws in providing their services;
  • They have obtained all necessary consents for any photos or content uploaded to the Platform.

9. Gratuity Distribution Obligations

Providers acknowledge that all gratuity collected through the Platform, whether mandatory or voluntary, is the property of the Provider's employees under California Labor Code Section 351 and applicable law. By accepting Bookings that include gratuity, Providers represent and warrant that:

  • All gratuity amounts received from EventSculpt or through direct charges will be distributed in full to the employees who performed the services, in accordance with applicable law;
  • The Provider will not retain, offset, deduct from, or use gratuity amounts to subsidize wages, business expenses, or any other purpose;
  • The Provider maintains records of gratuity distribution to employees and will provide such records to EventSculpt upon reasonable request;
  • The Provider will comply with all applicable federal, state, and local laws governing tips, gratuities, and service charges, including tip pooling restrictions.

EventSculpt's role is limited to passing gratuity through to the Provider. EventSculpt does not control, supervise, or verify the Provider's distribution of gratuity to employees. Providers who fail to distribute gratuity in accordance with applicable law may be subject to account suspension, removal from the Platform, and indemnification obligations under Terms of Service Section 9.3.

10. Changes to These Standards

These Standards may be updated with at least 14 days' notice. See the Terms of Service Section 12 for the tiered modification framework governing changes to this and other incorporated policies.
